Section 1. Vaping Awareness and Prevention.
Subdivision 1. Title. Allows the section to be referred to as the “Vaping Awareness and Prevention Act.”
Subdivision 2. Definitions. Defines “electronic delivery device” as having the meaning given in section 609.685, subdivision 1. Defines “heated tobacco product” as a tobacco product that produces aerosols containing nicotine and other chemicals that are inhaled through the mouth. Defines “public school” as a school district or charter school. Defines “vaping” as using an activated electronic delivery device or heated tobacco product.
Subdivision 3. Model instructional materials. Directs the Departments of Education and Health to work collaboratively to develop smoking prevention instructional materials for school districts with a focus on vaping and the use of electronic delivery devices and heated tobacco products.
Subdivision 4. School instruction requirements. Requires a public school to provide vaping prevention instruction at least once to students in grades 6 through 8. The school may use the materials developed under subdivision 3 or other smoking prevention instructional materials with a focus on vaping. Encourages a public school to provide vaping prevention instructions to students in grades 9 through 12.
Subdivision 5. Student survey. Directs the commissioner of education to include questions regarding tobacco use and vaping in the Minnesota student survey.
Effective Date: Makes the section effective January 1, 2021.
