|
S.F. No. 3202 [245A.0415] requires residential program license holders that have closed their program to destroy personal information of individuals served by the program, when statutes requiring preservation of the data no longer apply. Upon doing so, the license holders must submit a certificate of destruction to the commissioner. Failure to comply with the duty to destroy the information may be the basis for a data practices action or penalties from the commissioner. These requirements do not apply to programs that transfer ownership.
