S.F. No. 3071 addresses access to electronic communication information by government entities. This language was passed by the Senate in the 2019 Omnibus Data Practices bill.
Section 1 requires that a government entity obtain a search warrant prior to accessing electronic communication information. Provides exceptions for emergencies and consent. Addresses notice to the subject of the information and the filing, sealing, and reporting on warrants under these provisions. Defines terms. Of note, “electronic communication information” is limited to the contents of electronic communications and the precise or approximate location of the sender or recipient at any point during the communication.
Sections 2 to 8 make conforming changes consistent with section 1.
