S.F. No. 3287 [609.539] establishes criminal penalties for offering, paying, soliciting, or receiving remuneration in the form of kickbacks, bribes, or rebates in return for applying for or receiving assistance from human services programs. Individuals committing the listed violations may be sentenced according to the criminal penalties for theft, which are calculated based on the value of the good, facility, service, or payment that is the subject of the violation. Forms of remuneration that are exempted from criminal penalty under federal law are also exempted from this provision.
