Section 1. School calendar adjustment; 2018-2019 school year.
Subdivision 1. Required school days and hours. (a) Authorizes a local school board or charter school that canceled school on one or more days during the 2018-2019 school year due to health and safety concerns to count those days and hours of instruction lost for the purposes of calculating the number of hours and days in the school year and in the calculation of average daily membership.
(b) Requires a district to report to the commissioner if the district would have fallen short of the required days and hours of instruction without the authority provided in this section. Encourages these districts to adopt an e-learning day plan.
(c) A school board that resolves to count a day that school was canceled as an instructional day must compensate employees and contract employees.
Subd. 2. Instructional day; employees. (a) Makes the subdivision applicable to an employee of a school district that resolves to count a day that school was canceled as an instructional day. The employee must have been scheduled to work on that day, did not work, and did not receive compensation for that day.
(b) Requires the school district to allow the employee the opportunity to work on another day and be compensated, or compensate the employee for the day not worked.
Subd. 3. Contract employer to pay eligible employees. (a) Defines “contract employer” as an employer who provides student-related services throughout the school year to a school district. Defines “eligible employee” as a person whose primary task is to provide services to students in the district, who was scheduled to work on a day that school was canceled, who did not work on that day, and was not compensated for that day.
(b) Requires a school district to notify a contract employer of the days counted as instructional days under subdivision 1.
(c) Requires a contract employer to notify the district of its intention to compensate eligible employees for the hours of pay lost due to a school cancellation. Requires the district to fully compensate the contract employer.
(d) Allows the district and contract employer to adjust the contract rate under special circumstances.
Subd. 4. Probationary teachers. Adjusts the minimum number of days of teacher service required for a probationary teacher for the 2018-2019 school year.
Subd. 5. Accounting. Allows services paid under subdivision 2 or 3 to be charged to the same Uniform Financial Accounting and Reporting Standards object code to which the service is charged for an instructional day.
Effective date. Makes the section effective immediately.
