Section 1 [Reporting of Violations], paragraph (a), requires a state employee to report evidence that a party to a state contract is in violation of the contract’s terms. The employee must make the report to the employee’s supervisor, the commissioner of administration or the commissioner’s designee, or the legislative auditor. (Under current law, state employees have this reporting requirement for violation of laws or rules governing state contracts.)
Paragraph (b) requires the commissioner of administration to try to determine whether a violation of law or breach of contract has occurred. If the commissioner cannot conclude that no violation or breach has occurred, then the commissioner must refer the matter to the attorney general.
Section 2 [Cooperative Purchasing; Motor Vehicle Sales] requires that a cooperative purchasing agreement for motor vehicles include certain terms to minimize or eliminate risk that a given purchase won’t be subject to a cooperative purchasing agreement. The cooperative purchasing agreement must obligate the vendor to provide written notice of whether the cooperative purchasing agreement applies to a given sale.
