S.F. No. 1532 amends statutory provisions relating to certified community behavioral health clinics (CCBHC), to accommodate the end of the CCBHC demonstration project.
Section 1 (245.735, subdivision 3) permits CCBHCs to employ licensed alcohol and drug counselors and to provide clinic services to both individuals and families. The section removes the requirement for CCBHCs to be certified for provision of integrated treatment for co-occurring mental illness and substance abuse disorders, and adds a requirement for CCBHCs providing peer services to comply with the statutory standards relating to peer services. The section permits the commissioner of human services to grant a variance for CCBHCs that are not approved for prospective medical assistance payment, if the variance does not increase the state’s chare of the costs. The section removes the directives to the commissioner to establish a prospective medical assistance payment system for CCBHCs, to seek federal approval to continue federal financial participation in payment for CCBHC services, and to certify at least one CCBHC in an urban area and in a rural area.
Section 2 (256B.0625, subdivision 5m) adds CCBHC services to the statute listing services covered under medical assistance, and directs the commissioner of human services to establish a prospective medical assistance payment system for CCBHC services. The section permits the commissioner to limit the number of CCBHCs in the prospective payment system, and to prioritize certain CCBHCs, to ensure that the prospective claims do not exceed the appropriated funds. The section provides guidelines for operating the prospective payment system.
Section 3 (256B.0625, subdivision 57) makes a conforming change.
