SF 632 allows for early termination from the metropolitan agricultural preserves program upon a request by the landowner, and approval by a majority vote of the authority (defined as the unit of government exercising planning and zoning authority over the land.) To be eligible for early termination, the land must be enrolled in the program for at least eight years, and the landowner must provide notice to the authority on a form provided by the Commissioner of Agriculture. The notice must describe the property for which termination is desired, and the date of termination.
Under current law, a landowner must commit to the program for a minimum of eight years, and also provide an eight-year termination notice before the land can be removed. Early termination is permitted only upon designation of a public emergency, or upon the death of an owner.
Effective the day following final enactment.
