|
Minnesota Statutes, section 13.055, requires a government entity to notify individuals whose private or confidential data is affected by a breach in data security. Under current law, a breach does not occur unless there was unauthorized acquisition of the data by a person “with intent to use the data for nongovernmental purposes.” S.F. 248 removes the intent requirement from the breach notification statute.
This bill language was recommended by the Legislative Commission on Data Practices on December 7, 2018.
