1.3 "Sec. 6.
[123B.023] NO MANDATES WITHOUT FUNDING.
1.4 Subdivision 1. District noncompliance allowed. Until the amount of revenue needed
1.5to pay for a mandate identified in state law or rule is appropriated, a school district
is not
1.6required to comply with a state mandate that:
1.7(1) affects the daily operation of schools;
1.8(2) affects the authority of a school board to establish locally developed education
1.9policies;
1.10(3) changes a school district's curriculum; or
1.11(4) changes a school district's spending priorities.
1.12 Subd. 2. Exceptions. A school district must comply with a mandate if the amount of
1.13revenue needed for compliance is incidental compared to the school district's total
budget.
1.14A school district must continue to comply with any law governing financial audit
1.15requirements or directly affecting the life, safety, and health of students.
1.16EFFECTIVE DATE.This section applies to state mandates that are in effect after June
1.1730, 2025."
