H.F. No. 3489 as follows:
1.2Delete everything after the enacting clause and insert:
1.3 "Section 1. Minnesota Statutes 2022, section 121A.582, is amended by adding a subdivision
1.4to read:
1.5 Subd. 1a. Reporting. (a) Districts must report data on their use of any reasonable force
1.6used on a student with a disability to correct or restrain the student to prevent
bodily harm
1.7or death to the student or another that is consistent with the definition of physical
holding
1.8under section 125A.0941, paragraph (c), as outlined in section 125A.0942, subdivision
3,
1.9paragraph (b).
1.10(b) Beginning with the 2024-2025 school year, districts must report annually by July
1.1115, in a form and manner determined by the commissioner, data from the prior school
year
1.12about any reasonable force used on a general education student to correct or restrain
the
1.13student to prevent bodily harm or death to the student or another that is consistent
with the
1.14definition of physical holding under section 125A.0941, paragraph (c).
1.15EFFECTIVE DATE.This section is effective the day following final enactment.
1.16 Sec. 2.
REPEALER.
1.17Laws 2023, chapter 55, article 2, section 36; and Laws 2023, chapter 55, article 12,
1.18section 4, are repealed.
