SF1665 modifies the areas covered under continuing education for license renewal to practice mortuary science and specifies the requirements that unlicensed personnel must meet before being permitted by a licensed crematory to perform cremations.

Section 1(149A.40, subd. 11) adds cremation as one of the areas included in the required continuing education in body preparation, care, and handling.

Section 2 (149A.95, subd. 3) Paragraph (a) states that if a licensed crematory is employing unlicensed personnel, the licensed crematory must ensure that they are properly trained and are in compliance with the requirements in paragraph (b).

Paragraph (b) requires unlicensed personnel performing cremations at a licensed crematory to:

  1. complete a certified crematory operator course that is approved by the commissioner;
  2. obtain a crematory operator certification that must be posted at the licensed crematory where the unlicensed personnel performs cremations; and
  3. maintain certification either through recertification or complete seven hours of continuing education credits in crematory operation every five years.

Sections 1 and 2 are effective January 1, 2019, and applies to mortuary science license renewals renewed on or after that date and to cremations performed by unlicensed cremations on or after that date.
