This bill amends the law governing self-service storage facility rentals.

Section 1 amends the definition of “owner” to include operators, lessors, sublessors or agents, or other persons authorized to manage the facility.

Section 2 amends the definition of “rental agreement” to include an agreement that modifies, as well as establishes, the terms and conditions of use of the space.

Section 3 expands the lien of an owner on personal property in a self-service storage facility to include late fees.

Section 4 adds new provisions governing late fees and collection costs.  A storage facility may charge an occupant a late fee of no more than $20 per month or 20% of the monthly fee, whichever is greater (the author’s amendment changes these amounts to $15 per month or 15%).

Section 5 clarifies that online auctions can be used to sell personal property as an alternative to holding auction in person.

All sections of the bill contain an immediate effective date.
