S.F. No. 3216 - Clarifying Charge to Counties for State Confinement of Juvenile Offenders

Author: Senator Mark T. Johnson

Prepared By: Chris Turner, Senate Fiscal Analyst (651/296-4350)

Date: March 19, 2018

Minnesota currently has two conflicting statutes governing the amount counties are charged for the cost of confining juveniles at MCF-Red Wing.  Minnesota Statutes, section 401.13, enacted in 1973, states that Community Corrections Act counties must pay the actual cost of confinement, excluding education costs.  Section 242.192, enacted in 1997, states that all counties are responsible for 65 percent of the cost of confinement, excluding education costs.  The latter has been the controlling statute for the last 20 years.

This bill repeals section 401.13 and strikes the requirement in section 242.192 that the Commissioner of Corrections set the Red Wing per diem at a price that balances expense and revenue over a two-year period.
