S.F. No. 151 - Motor Vehicle Forfeiture Provisions Modification for Inclusion of More Than One Vehicle Owner

Author: Senator Scott J. Newman

Prepared By: Chris Turner, Senate Fiscal Analyst (651/296-4350)

Date: January 23, 2017

The bill modifies DWI forfeiture law’s innocent owner defense to allow, in instances of joint ownership, any innocent owner who petitions the court to assert the defense.  Under current law (as interpreted by case law), all owners must be considered innocent for the defense to apply.
